Hospitality Industry Legal Risks: Connecticut Hotel Owners Settle “Negligence Lawsuit” For $1 Million; Woman Tripped Over “Bunched, Wrinkled Carpet” Which Required “Elbow Replacement Surgeries”

“…(the plaintiff) was walking from the restaurant to the front lobby when she tripped on a bunched and wrinkled carpet, catching her toe on it Hospitality Industry Injury Lawsuitsand landing on her elbow…(she) had five surgeries, and when the elbow would not heal right, underwent a total elbow replacement…her medical bills totaled $240,000, which will be repaid with proceeds from the settlement, he said…as early as 2009, Holiday Inn, which was threatnening to pull the hotel’s license because of various maintenance issues, had inspected the hotel and reported that the carpet in the restaurant was loose…(attorneys) discovered that members of the hotel staff had tripped on the rug and complained to the management…”

The owners of the former Holiday Inn on North Frontage Road agreed this week to pay $1 million to a 77-year-old St. Louis woman who fractured her elbow after tripping over a loose carpet and falling as she exited the hotel’s restaurant. Heritage New London LLC, the corporation that owns the property and managed the hotel agreed to the settlement after five days of jury selection in New London Superior Court.

Norma Minke was part of a visiting tour group that stayed at the hotel on October 3, 2010, according to her attorney, Joseph M. Barnes of the Reardon Law Firm.

During the discovery process, Barnes said he deposed the corporation owner, Sunil Nayak of Princeton, NJ. Barnes said he learned that as early as 2009, Holiday Inn, which was threatnening to pull the hotel’s license because of various maintenance issues, had inspected the hotel and reported that the carpet in the restaurant was loose. The report specifically identified the location of the incident, Barnes said. He also discovered that members of the hotel staff had tripped on the rug and complained to the management.

Hospitality Industry Legal Risks: Illinois Restaurant Sued For “Negligence” By Woman Who Slipped In Puddle Of Water; Seeking $50,000 For “Leg Injuries, Pain And Suffering”

“…(the plaintiff) blames the restaurant for causing her injuries, saying its employees negligently allowed a puddle of water to remain on its Hospitality Industry Injury Lawsuitspremises, failed to remove the puddle, failed to reasonably inspect the premises and failed to properly manage the restaurant…In addition to her injuries, (she) became sick, lame, disordered and disabled; experienced pain and suffering; incurred medical costs; and suffered disability and disfigurement, the suit states. She also lost earnings and wages, the complaint says…”

A woman claims suffered left knee and leg injuries after she fell on a puddle of water at a Mexican restaurant. Andrea B. Mercer filed a lawsuit Aug. 29 in Madison County Circuit Court against Chivas doing business as Carisilos Mexican Restaurant. In her complaint, Mercer alleges she was eating at Carisilos, which is located at 1978 Vandalia St. in Collinsville, on Sept. 3, 2011, when she fell on a puddle of water in the restaurant.

In her complaint, Mercer seeks a judgment of more than $50,000, plus costs and other relief the court deems just.

Hospitality Industry Legal Risks: Texas Restaurant Sued For $1 Million By Customer Who “Slipped And Fell On Peanut Shells” On The Floor; Claims “Unreasonably Dangerous Condition”

“…The lawsuit states that (the plaintiff) slipped and fell in the restaurant on March 19, and that the restaurant and employees knew or should Hospitality Industry Injury Lawsuitshave known that the peanut shells on the floor created an unreasonably dangerous condition…(she) is suing for damages for physical pain, mental anguish, physical impairment, medical expenses, lost wages, loss of earning capacity and court costs…”

A Harlingen woman is seeking $1 million after she claims she slipped and fell on peanut shells on the floor of a local restaurant. Amelia Tijerina has filed a civil lawsuit arguing that Texas RoadHouse Inc. is responsible for the peanut shells on the restaurant’s floor. RoadHouse has denied Tijerina’s allegations and demands proof.

Tijerina sued the restaurant in state district court, but Texas RoadHouse moved the lawsuit to federal court, according to court records.

She also maintains that the restaurant or employees should have warned her about the peanut shells or should have removed them.

She is presented by Attorney Salvador Garcia and Jorge A. Green with The Green Law Firm of Brownsville.

Attorneys Karl W. Koen, Robert J. Collins, and Rachel R. Vulpitta of Gauntt, Earl, Binney & Koen, LLP of Dallas, who represent Texas RoadHouse, contend that it was Tijerina’s own actions or omissions that caused or contributed to her injury.

Hospitality Industry Legal Risks: Illinois Restaurant Sued For Negligence By Woman Who Slipped On "Wet And Slick Floor"; Lawsuit Seeks $50,000 In Medical Costs And Damages

“…as she was walking to the restroom, (the woman) slipped on a wet and slick floor…she suffered severe pain slip_and_fall accidentand discomfort, incurred medical costs and endured damages of more than $50,000, the suit states…”

A woman claims she suffered severe injuries after she slipped and fell on a wet floor at a restaurant. Janet L. Althoff filed a lawsuit Nov. 26 in Madison County Circuit Court against Ali Veseli doing business as Round Table Family Restaurant.

Althoff claims she was visiting Round Table at about 2:30 p.m. on March 9 when she walked from a dining room to a unisex restroom.

Althoff blames Veseli for causing her injuries, saying the restaurant negligently failed to correct the unsafe condition and failed to warn of the wet floor. In her complaint, Althoff seeks an unspecified judgment, plus other relief the court deems just.

Hospitality Industry Safety Risks: Texas Hotel Sued For "Negligence" After Man Slips And Falls Down Flight Of Stairs; Failure To Post Warning Of Wet Carpet

“…According to the lawsuit, the hotel had washed, shampooed or cleaned its carpets prior to Steele’s arrival and left them in a wet and slippery condition without any warning to Steele…”

The defendant is accused of negligence for failing to inspect its premises to be sure that they were free of unreasonably dangerous conditions, dry its floors after cleaning, limit access to areas in which the floors were not yet dry, warn its invitees of the existence of the wet floors, select and hire competent contractors in such a way as to ensure that they were not creating an unreasonable risk of harm to invitees.

A Louisiana man has filed a lawsuit against the owners of a Comfort Inn claiming that they failed to warn him that the carpet was wet, which caused him to fall down an entire flight of stairs. Walter Steele filed suit against Laxmi Lodging Inc. on Oct. 12 in the Eastern District of Texas, Marshall Division.

The incident occurred on Sept. 9, 2012 as Steele was attempting to exit a Comfort Inn in Palestine, Texas, owned by the defendant by the way of the staircase when his foot slipped on the wet flooring causing him to fall down an entire flight of stairs and onto the concrete floor.  The fall caused Steele serious and permanent disabling injuries to his back and spine.

The plaintiff is seeking damages for medical expenses, lost earnings, physical impairment, pain, suffering, mental anguish, and lost earning capacity.

Hospitality Industry Legal Risks: Texas Motel Sued By Maid Injured After Slipping Near Leaky Faucet In Break Room

She was walking near the break room area when she slipped and fell in water that had been leaking from a faulty sink…The plaintiff is suing for his alleged past and future medical expenses, mental anguish, pain and lost wages, plus all court costs.

Alleging a company failed to post a warning sign of a known danger, a maid is suing the owners of a Super 8 Motel, claiming a leaky faucet near the break room caused her to slip and fall two years ago. Port Arthur local Gricelda Gutierrez filed suit against Triangle Hospitality Inc. on July 27 in Jefferson County District Court.

According to the lawsuit, on July 27, 2010, Gutierrez was working at Triangle Hospitality’s Super 8 Motel in Port Arthur as a housekeeper. Gutierrez claims she was injured in the fall, although the suit fails to state her alleged injuries.

She accuses the defendant of negligently failing to provide her with a safe work area, alleging that the company knew of the leaky facet and did nothing to remedy the unsafe working conditions.

The suit states the defendant failed to post a warning sign of a known danger.

Hospitality Industry Safety Risks: Illinois Hotel Sued For Negligence By Man In "Slip And Fall" Accident; Claims Permanent Injuries

“…(hotel  is accused) of negligence for allegedly failing to keep the hotel lobby floor clean and dry. He says he has suffered — and will continue to suffer — physical and mental pain and anguish. Cattani is asking for an undetermined amount of money for medical expenses and lost income in addition to court costs…”

A Collinsville man claims the “carelessness” of owners and managers of a local hotel led him to slip and fall in the lobby. Bobby Cattani filed a lawsuit July 10 in Madison County Circuit Court against Lodging Hospitality Management, doing business as Doubletree Hotel. Hotel owner, Colhot LLC, is also named as a defendant.

Just after 11 p.m. on Aug. 2, 2010, Cattani says he slipped and fell on a “liquid substance that had accumulated on the floor” of the Doubletree Hotel on Eastport Plaza Drive. He says he severely and permanently injured numerous parts of his body along with his nervous system.

Kanters says on April 18, 2010, he broke his ankle while staying as a guest at the Hilton Garden Inn Galleria, located at 3201 Sage Road in Memorial.

A Harris County man is suing over claims he was hurt while staying at a Spring-area extended-stay hotel.
Roy Rodriguez filed a lawsuit on Jan. 20 in Harris County District Court against Sun Suites of Green’s Point, and others, citing negligence.

Rodriguez says he suffered injuries as a guest at Sun Suites Extended Stay Hotel, located at 12010 Kuykendahl Road in Spring. Rodriguez is seeking damages and court costs. He is being represented in the case by Houston attorney Mehran “Mike” Talabi.
