Hospitality Industry Spa Treatment Risks: Florida Hotel Sued By Woman Who Claims "Near-Fatal Massage And Treatment" Has Resulted In Two Years Of Medical Expenses

“…a spa employee slathered her in aromatic essential oils, aloe, and shea butter. But the curvy Jersey girl began to have doubts when she was wrapped tightly in a “cellophane-type material” and helped inside something called an Alpha Massage Capsule. It looked like a space-age coffin…”

“…Once inside, she couldn’t move. As the temperature soared, she started to become overheated and lightheaded. She shouted for help, but the attendant had vanished, the lawsuit says. Then Berean passed out…”

According to a lawsuit she filed earlier this month, Berean’s spa treatment (at the Howard Johnson Hotel in Miami Beach in July 2010) turned into one hot, buttery nightmare. The spa promised to leave her skin “glowing,” but Berean’s “hot butter wrap” nearly melted her instead. After two years of medical bills, she wants payback.

“She was stuck in this little heating egg,” says Berean’s lawyer, Andrew Norden. “She yelled, but nobody came to help her. Then she passed out. It was terrifying for her.”

Lawyers representing Nirvana Spa did not respond to requests for comment. Berean also declined to speak to New Times about her ordeal, but her attorney and lawsuit paint a terrifying picture of relaxation gone awry.

When the Nirvana Spa employee finally returned, she took Berean out of the capsule and unwrapped her like an aborted butterfly. Berean gradually came to, but instead of calling paramedics, the employee put the barely conscious client into the shower and left her alone again, according to the lawsuit. Berean fainted a second time and hit her head.

Berean has undergone “extensive medical care and treatment” because of the near-fatal massage, the lawsuit claims. But Natalia Bazhenova, Nirvana’s current manager who joined the spa after the incident, says the story sounds suspicious.

Hospitality Industry Health Risks: Oregon Restaurants Will Not Be Required To Prohibit "Bare-Hand Contact" Pending Review; "Double Hand-Washing Rule" To Be Enforced

“…(the State of Oregon) decided to remove the bare-hand contact prohibition from the proposed rules because this issue needs further discussion…the group will convene multiple times over the next few months. The state will continue to enforce its double hand-washing rule for food servers until any changes are announced…”

The Oregon Health Authority is shelving its proposed rule mandating that restaurant workers not prepare food with their bare hands. State health officials have decided to convene a work-group on standards to prevent food-borne illness. The group will work toward a substitute to the so-called “no bare hand contact” rule originally proposed by the Health Authority.

That provision was to take effect on July 1, but was delayed after protests from the food service industry. The work group will include restaurateurs, legislators, medical professionals and others.

Gail Shibley, the administrator of the OHA’s Public Health Division, said her agency is looking for diverse opinions. “We think we can get the wisdom from restaurateurs as well as a variety of other folks to really dig into the details of this specific provision, and move forward at a later date,” she said.

Hospitality Industry Security Risks: "Intoxicated" New York Hotel Guests Pull Fire Alarm Outside Lobby Doors After Being Locked Out In Early Morning Hours; Arrested On Felony Charges Of Falsely Reporting A Fire

“…(the men) proceeded to strike the lobby’s sliding glass doors “with such force as to rock them and nearly break them from their hinges…they then pulled the fire alarm outside the hotel’s lobby, resulting in their arrest on charges of falsely reporting a fire, a felony, and reckless endangerment, a misdemeanor…”

In the wee hours of Saturday morning, Lewis and his brother, Lamar, found themselves locked out of a hotel in downtown Albany, N.Y. They were intoxicated, according to police, and apparently forgot their room key. Eagles running back Dion Lewis found himself in some trouble over the weekend.

“I want to apologize to my family, the Albany community, the Eagles organization and fans, and to the NFL for my involvement in an incident this past weekend,” Lewis said in a team-issued statement “It was never my intention to cause any public alarm or damage any property. I am sorry for any embarrassment and inconvenience that my actions have caused.”

The 21-year-old Lewis, whom the Eagles selected in the fifth round of the 2011 NFL draft, was released after his arraignment in court. His brother was being held in jail because of two previous felony charges, the Times Union reported.

Hospitality Industry Security Risks: Husband Of Slain Woman Sues California Hotel In Wrongful Death Lawsuit; Claims Homeless People Were Known Threat To Guests

“…court documents say that hotel security were aware that homeless people and others had committed “assaults with deadly weapons, thefts, and other disturbances,” but “failed to take any security measures” to keep guests safe, the complaint alleges…”

The lawsuit claims that a homeless man or “uninvited third party” walked through an unsecured first-floor door and killed Finley’s wife while he was sleeping in the couple’s sixth-floor room.

A wrongful death lawsuit against the Biltmore Hotel moved forward on Monday when a man whose wife was found dead at the LA landmark during an audition for “America’s Got Talent” alleged the hotel destroyed evidence to cover up the slaying of his wife.

The body of his wife, Laura, was found in a stairwell at the famed downtown hotel on Oct. 23, 2010.

Hotel security failed to warn guests about security issues related to remodeling work being done on the first and second floors, court documents said.

Hotel security found Laura Finley’s body at the bottom of the first-floor staircase. The body of the 48-year-old woman was found with no top and wearing pants that were inside out. Her diamond rings were missing, court papers said.

Hospitality Industry Crime Risks: Florida Motels To Work With Police To Identify And Avoid Meth Lab Operations In Guest Rooms

At the end of the month … police will have a training program to educate hotels on how to identify potential meth dealers looking for a temporary base to cook. In the last three months there have been three drug lab busts in two Motel 6 locations in Jacksonville.

The problem of meth labs in local motel rooms seems to be growing, but there is a renewed focus on stopping the spread.

Fred Pozin, General Manager of the Ramada in Mandarin, tells WOKV they work directly with the Sheriff’s Office to try and seek out the users.

Hospitiality Industry Security Risks: Ohio Hotel Employees Accused Of Raping Two Women Guests In Hotel Room

The 44- and 45-year-old women reported being raped by both men after returning to their room from a party. The indictment states that the women were vaginally raped while they were impaired and unable to resist or consent.

A Hampton Inn security guard and a valet are accused of raping two women May 13 in the women’s hotel room. Solomon Baba, 23, of Cleveland, and Kevin Kozieracki, 37, of Middleburg Heights, are charged with rape, kidnapping and burglary.

Baba, the valet, is being held on a $100,000 bond, while Kozieracki, is being held on a $250,000 bond. They are due back in Cuyahoga County Common Pleas Court for a hearing Thursday.

Hospitality Industry Theft Risks: Florida Hotels And Guests Defrauded By Homeless Man; Watched Guests Leave Room And Claimed He Was That Person

“…He would apparently watch a guest leave then go into the room and claim he’s that person.  Once in the room, police told WFTV Price would call the front desk and say he wanted to extend the stay, sometimes by 10 days…”

“…At the Portofino Bay Hotel at Universal, Price allegedly racked up nearly $9,000 in charges on an Ohio man’s credit card…”

A homeless man spent Friday night in the Orange County Jail.  He was busted after police said he posed as a guest at lavish hotels and went on spending sprees that his victims paid for. David Price has been homeless for the past two years.  On some nights he found shelter at the most lavish hotels in Orange County including The Ritz Carlton, Hard Rock Hotel and Loews Portofino Bay.  He stayed at those hotels on other people’s dime.

A few days ago, police arrested Price after he finagled his way into a room at the Hard Rock Hotel that was previously occupied by a hotel worker.  Security officers knew the employee had already left so they called the police.  Officers apparently found items from other hotels in the room, including The Peabody on International Drive and the Four Seasons in Miami.

Hospitality Industry Employee Risks: Illinois Restaurant Sued For $50,000 By Guest Claiming "Battery And Negligence" After Employee Assault

“…(restaurant employee) came from behind  the pick-up counter to attack Shears, “violently pushing her the glass front  door causing the glass door to shatter” and severely injure Shears’ leg,  according to the suit…Shears is suing (employee) and the restaurant for battery and negligent and  intentional infliction of emotional distress…”

A woman is suing a Chicago restaurant and its employee for  $50,000 after she claims she was violently thrown through a glass door for  requesting extra packets of sauce.

A lawsuit filed this week in Cook County Court states the incident happened  after Chicago resident Tiawanda Shears placed a to-go order at the New China Wok  Limited, at 752 W. Garfield Blvd., on May 14. 

After receiving her food, Shears noticed the order contained  only one sauce packet and “politely” asked employee Hui Tian Wu for more sauce,  according to the lawsuit.

Hospitality Industry Health Risks: Oregon Restaurants Fight New Rule Requiring Cooks To Wear Gloves Before Touching Food; Hand-Washing Practices Are Central Concern

“…the Oregon Health Authority’s Foodborne Illness Prevention department said the measure was created to prevent the spread of norovirus, the most common cause of food poisoning. It’s often spread through improper hand washing by employees after they use the bathroom… a 2003 health authority survey in which restaurant inspectors found at least one hand-washing violation at nearly two-thirds of Oregon eateries…”

Oregon restaurant owners and chefs recently earned a small victory, delaying by several months a new state rule that could make dining out more expensive, create waste and, despite its good intentions, do little to protect public health.

The rule, initially set to take effect Sunday, would require cooks to wear gloves or otherwise avoid touching food with their bare hands. But restaurant owners argued the requirement won’t prove safer than the state’s current rigorous hand-washing practices — and the science seems to back them up.

At least a half-dozen recent studies have concluded the same: Counterintuitively, wearing gloves does little to prevent the spread of bacteria compared with effective hand washing. Wearing gloves has been found to reduce the number of times people wash their hands, while warm, moist conditions create a hothouse for bacteria to grow. A 2005 report from the University of Oklahoma Health Sciences Center that analyzed grilled tortillas found more staph, coliform and other harmful bacteria on the samples prepared by workers wearing gloves.

“Gloves lead to a bulletproof-vest feeling,” said Bryan Steelman, owner of the Mexican eatery Por Que No? and among the restaurateurs leading the charge against the new rule. “Cooks think, ‘I have a glove on. I don’t need to wash my hands.'”

Hospitality Industry Information Risks: Federal Trade Commission (FTC) Sues Hotel Operator Over Guest Account Data Theft That Results In Over $10 Million Of Credit Card Fraud

“… fraudulent charges on Wyndham’s consumer accounts totaled more than $10.6 million following three data breaches in less than two years. The breaches occurred in April 2008, March 2009 and in late 2009…”

The Federal Trade Commission said repeated failures to secure consumer data led to hundreds of thousands of consumers’ payment card information being exported to an Internet domain address registered in Russia.

Wyndham, which operates several hotel brands, including the value-oriented Days Inn and Super 8, is one of a large number of organizations that acknowledged in the past three years that they had been hacked by people seeking either financial gain or intellectual property.

Other victims have included entertainment giant Sony, the International Monetary Fund, Google, Lockheed Martin and Citigroup.
