Hospitality Industry Legal Risks: New York Restaurant Sued For $1 Million For “Refusing Service” To Disabled War Veteran Using Service Dog To Ease “Posttraumatic Stress Disorder (PTSD)”

“…(the plaintiff), who uses the dog to ease his posttraumatic stress disorder, is suing  for $1 million in Manhattan Federal Court. He claims the Hospitality Industry ADA Lawsuitsincident humiliated him and exacerbated his PTSD…(he) said he tried to reason with the employee invoking the Americans with  Disabilities Act (ADA), which permits service animals in public spots…(the plaintiff), who won an undisclosed settlement in 2011 after suing a McDonald’s in  Times Square over a similar experience, said he left the KFC rather than  continue the argument…”

A disabled Iraq War veteran who worked at Ground Zero says the Colonel  treated him like trash. Charles Hernandez, 50, a retired public school administrator, claims he was  refused service at a KFC in the Bronx after he brought his service dog into the  fried chicken joint.

His suit says the KFC worker violated federal, state and city laws and caused  Hernandez distress. The suit also names as defendants KFC manager Sade Clarke,  the restaurant’s owner, Star Partner Enterprises Two LLC, and that company’s  principal owner, Thomas Rose.

Hospitality Industry Security Risk Management: Hotels Face Increased Risk Of "Guestroom Burglaries" From Electronic Door Lock Hacking Devices

As many of you may have heard, the computer “hacking” community has made a small device that can open Onity hotel guestroom door locks. It costs approximately $50 in readily available electronic parts, and the device has been concealed in an iPhone case and a Dry Erase marking pen body (yes, the felt tipped dry erase pen used on whiteboards).

The hacking device plugs into the door locks, and opens the door. It shows up on the lock readout as a “portable programmer” use, but no serial number for the portable programmer is noted.

**We are now experiencing actual guestroom burglaries and guest thefts by use of these devices in Texas. Multiple rooms have been hit at several hotels. An arrest was made in Houston on some of these burglaries, so I hope to have additional info on that very soon.

**I am also receiving reports from hotels in Florida that a similar “hacker” has been seen carrying a laptop computer and using a key card (possibly connected to the laptop) to open guestroom door locks. There have been several guestroom burglaries and actual witnesses who saw the suspect with his laptop, using a key card to access locked guestrooms.

Please TRAIN and notify your hotel staff that these burglaries are spreading across the country. Hotel staff should be vigilant while they are on the guest floors and paying attention to guests walking through hallways. Take time to watch guests walking through your hallways to ensure they are going to a room and entering it. Be very suspicious of someone carrying a laptop or small bag wandering the hallways. Greet guests and ask them if they need assistance. If they appear nervous, or cannot tell you what room they are looking for, escort them to the lobby, or escort them to where a security camera is, so you can get a picture of them. If they leave the hotel, follow them and try and write down a vehicle license plate on their vehicle. Your hotel staff has to be more active on your guest floors when they see people walking around.

Onity locks is not accepting liability for the defect in their hotel locks, and have offered a software fix for the problem. Onity is charging hotels to supply the fix.

I’m sorry to say that this burglary issue will only get bigger as the hackers share their tales and their build your own device details in the future.

Hospitality Industry Guest Risks: Police Arrest Massachussetts Hotel Guest For "Disturbing The Peace" After Refusing To Cease Loud Noises In Room

“…hotel security personnel stated that they had received multiple complaints relative to loud and unsettling noises coming from one of the rooms in the hotel…”

“…When told the hotel had a right to disinvite guests for bad behavior and excessive noise, the individual continued to verbally disrespect and disparage the officers. Officers arrested (man) and charged him with Disturbing the Peace…”

Officers responded to a call for a person or persons producing excessive amounts of noise at 1 Avenue de Lafayette (Hyatt Hotel). Security personnel further stated that occupants of the room were asked to put an end to the loud noises or face the prospect of being asked to leave the hotel.

Despite repeated warnings, the occupants continued to generate disturbing noises. When told they, the occupants, had to leave, the occupants told hotel security they weren’t going anywhere. Officers proceeded to the room to break the bad news to the occupants.

Upon entering the room, officers observed several empty beer and wine bottles strewn about the room. While officers were in the middle of providing an explanation as to the occupants had to leave, one individual in particular began yelling and complaining about his rights.

Hospitality Industry Guest Payment Risks: New Jersey Hotel Is Victim Of $3900 "Theft By Deception"; Two Teens Stay In Room After Pretending To Be Placed By Social Services Agency

Police have determined that 19-year-old Joshua Walton of Barnegat and a 17-year-old girl had stayed in the room. Both were charged with theft by deception.

Authorities say two New Jersey teens pretended to be placed in a motel by a social services agency and then ran up a bill of $3,900.

Long Beach police tell the Asbury Park Press that a woman claiming to work for Ocean County Social Services called a motel last summer and requested a room for a couple and their child.

The motel owner agreed to house them for two weeks, but later learned that the woman who had made the arrangements did not work for the agency.

Hospitality Industry Guest Security Risks: Denver Hotel's "Room Key System" Malfunctions Locking Guests Out Of Rooms For Three Hours

“Shortly after midnight on New Year’s Eve, the hotel experienced a malfunction of the electronic room lock system. Once we became aware of the situation, we contacted the manufacturer of the system who provided technical support…”

Due to the inconvenience, the hotel gave guests refunds for the room.

Guests at the 628-room Denver Tech Center Marriott were locked out of their rooms when the clock struck midnight New Years. A room key malfunction kept guests out of their rooms from midnight until about 3 a.m.

Crowds of people packed into the lobby hoping to get key cards that worked. Others went to sleep in hallways. Hotel guests say it got pretty wild. “It was like a madhouse in there. It was crazy. I thought riots were going to start,” said Kyle Novak.

Denver Police say an officer called for assistance around 12:40 after a large disturbance in the parking lot. There were numerous reports of assaults and property damage.

In response to the incident Jennifer Atkins, the hotel’s general manager released the following statement.

 “We are sorry for the inconvenience this caused and are providing the night’s lodging free of charge to all registered guests. We will continue to work closely with the manufacturer of the lock system to better understand what may have caused the malfunction and will do what we can to prevent a similar malfunction from happening in the future.”

Hospitality Industry Internet Risks: Connecticut Hotel Employees Assist Authorities In Arrest And Conviction Of Man For "Child Pornography" While Using Hotel Internet

Employees at the Marriott Hotel in Hartford, Conn., took action over the summer when they spotted a man trying to access a pornographic website in their hotel, the Hartford Courant reports.

They banned the man from the hotel, and then alerted authorities, leading to an investigation by agencies including the Hartford Police, FBI and the Connecticut Computer Crimes Task Force.

That investigation on Tuesday led to a guilty plea from the suspect who had been using Internet services almost daily at a variety of places including the hotel’s Starbucks Café and the nearby library, the article says.

He had previously been convicted of attempted child molestation, according to the FBI.

William Scott Van Wyk, 35, pleaded guilty in Hartford before U.S. District Judge Christopher Droney to a child pornography charge and one count of using the Internet to try to persuade a minor to engage in sexual activity, the story says.

He faces at least 15 years in prison, although he may receive a longer sentence due to his record.

Hospitality Industry Marketing Risks: Hotels Are Increasingly Reacting To "Negative" Postings On Social Media Sites As Guests Go "Online" Rather Than To Management

Social media has empowered consumers, forcing companies to be more transparent and responsive. That’s a good thing. But hotels have always been responsive, if not transparent. Lodging a complaint is as simple as marching up to the front desk.

So why is it that some guests, upon encountering an issue, log on to Twitter or Facebook and bring it to the attention of their entire social graph instead of to the one person who can fix it the problem: the manager?

  • Monitor review sites and social networks closely. Even if you aren’t active on them many of your guests likely are.
  • Respond quickly to all feedback, positive or negative.
  • If comments are negative, attempt to take it offline.
  • When responding to negative reviews and commentary, always thank, apologize, explain, invite back and follow-up. No excuses, and no bribes.
  • If guests are still on property, don’t let them leave until you’ve won them over. Convert twerrorists into twadvocates, so to speak.
  • If comments are offensive, abusive or repetitive, you have the option of ignoring them. Tweets have the shelf life of tuna sushi in the desert sun; Facebook wall posts can be deleted. Sanitize, but don’t censor.
  • A social media policy and guidelines will help minimize risks and prepare you to act swiftly to minimize fallout.
  • The more helpful and engaged employees are with guests the more likely guests will be to bring issues to their attention before logging on to Facebook.

Hospitality Industry Guest Privacy: Hotel Management Must Standardize Privacy Procedures For Entering, Cleaning And Inspecting Guest Rooms

“If someone has a couple of articles of clothes on the bed we will move them to make the bed…if they have expensive things on the bed – purses, electronics, cameras – we will not touch that bed.”

“…if there is something sensitive, like a closed wallet or laptop, a supervisor or manager will stand at the door for the employee’s safety…”

While every chain hotel has a set corporate policy, each individual hotel may be less stringent and abiding for the guest’s benefit.

“According to Iowa law, we can enter a room anytime we want,” Jepsen said. Generally, hotel staff won’t enter a room if they don’t suspect something may be wrong in the room, Jepsen said. With extended-stay guests, who are staying 30-40 days, they are required to enter the room a minimum of twice a week. They mainly change the sheets and make sure garbage isn’t piling up, but also they make sure their equipment isn’t damaged. By the end of 30 days, a mattress could be ruined or the guest could be smoking in the room, Jepsen said.

There are other reasons for entering a guest’s room. “There have been instances where guests put their ‘do not disturb’ sign up but they may have a medical issue,” said King. “It could go unnoticed for long periods of time.”

“In the back of our mind, we always know what our rights are and what the rights of our guests are,” she said. “You can’t always have rules written in stone.”

Protection exists for both the hotel and the guests. Country Inn & Suites and AmericInn, like most hotels, have video surveillance systems. Both also keep a log on what keys have been used on the room’s electronic doors.

With any serious crime, such as theft, the police are immediately contacted, Jepsen said. “If a guest reports a theft, it’s investigated to its fullest extent,” she said. This is also done because the hotels’ insurance providers require police statements for incidents.

“What I always do is I have everyone write a written statement and sign and date it,” Jepsen said.
