Hospitality Industry Legal Update: “Bill Requiring Sex-Offender Checks on Hotel Workers Advances”

One of those is the fact that the measure as approved by the panel Monday has no enforcement mechanism and no penaltiesarizonabackgroundchecks for those hotels that ignore the law. Hobbs said she is counting on key changes when the measure goes to the full Senate. And Sen. Steve Smith, R-Maricopa, said he wants something in the legislation to ensure there are regular checks made of employees, not just at the time they are hired.

Told of the rapes of two guests in separate incidents in Mesa, members of a Senate panel voted Monday to require hotels to see if those who have access to room keys are sex offenders.

SB 1432 spells out that owners or managers have to use one of two available Internet websites before hiring anyone who can get into a guest’s room. If the employee shows up on either one, the hotel is barred from providing keys, keycards or any other method of getting into a room.

The vote followed testimony of attorneys who represent two women who were attacked in two separate incidents at two separate hotels — both reportedly by the same man.

Hospitality Industry Management Update: “Hotel Housekeepers Are at Great Risk for Sexual Assault From Guests”

“Women described men who insisted they close the door while cleaning, grabbed their hands as they handed over change and asked where they could “find a girl.”housekeeper-387x580 Kensbock and her colleagues identified a few factors that put women in the hotel industry at a heightened risk for sexual harassment, including the “gendered” nature of their work as housekeepers and their lack of power relative to the guests…Most of the women in Kensbock’s study coped with harassment using passive strategies, like humor or deflection. Though the hotel management had protocols they could follow to report inappropriate behavior, women—fearing guests would retaliate by leaving negative surveys—rarely complained.”

When Dominique Strauss-Kahn was accused of assaulting Nafissatou Diallo, the maid who was sent to clean his hotel room, hospitality workers thought the story seemed all-too-plausible. In a New York Times op-ed, Jacob Tomsky, a veteran of the hotel industry, wrote that housekeepers are assaulted by guests “more often than you’d think,” and that their employers don’t offer much protection. In a recent account on xoJane, an anonymous woman describes a decade’s worth of sexual harassment in different parts of the hotel industry—from working the front desk to cleaning rooms. It’s so systemic, she says, that the women developed coordinated strategies to cope with it—like enlisting other housekeepers to stay with them when they’re assigned to clean the room of a “known pervert.”

Hospitality Industry Legal Update: “Arizona Lawmakers Want Background Checks for Hotel Workers”

Neither attorney knew of the man’s current location…”

Hobbs said the existing sex-offender laws — those that dictate where an offender can live and work — are in place to keep the public safe and aware.

“It is unthinkable that this registered offender has exploited loopholes in the law to gain access to sleeping hotel guests and to reoffend,” she said.

Friday’s press conference was the first time the prospect of legislative efforts on the issue had been brought to the attention of the Arizona Lodging & Tourism Association, and officials were unaware of what a proposal would entail, said Kristen Jarnagin, senior vice president of the trade group.

Hospitality Industry Legal Risks: Maryland Restaurant Owner Faces “Sexual Harassment And Retaliation” Charges In Lawsuit Filed By EEOC

SPOA, LLC, which runs the Italian restaurants Basta Pasta in Fallston and Lutherville-Timonium, Md., subjected female employees to flagrant sexual harassment and fired a manager who complained about the harassment, the U.S. Equal Employment Opportunity Commission (EEOC) charged in a lawsuit filed today.

The EEOC alleged that the restaurant owner repeatedly subjected female employees, some of whom were teenagers, to unwelcome and offensive sexual harassment, including touching them on their buttocks, lower backs and shoulders; rubbing his genitalia against the buttocks of female employees; leering at female employees and making comments about their bodies, including calling them “sexy” or “hot;” making sexually suggestive remarks and crude sexual innuendos; and asking for massages.

The EEOC further charged that the owner pressured female employees to have alcoholic drinks at the end of their shifts and acted offended if they did not stay and drink.  The EEOC alleges that the owner gave one female employee, “Mary Smith,” alcohol, causing her to pass out and later wake up vomiting, and that Smith believed the owner drugged her in an attempt to sexually assault her.  The EEOC also charged that the owner took another female employee, “Jane Doe,” to his house, purportedly to talk about a management opportunity, but instead Doe believes he drugged and sexually assaulted her.  (Given the public interest in protecting the identities of sexual assault victims and attempted sexual assault victims, the EEOC is utilizing pseudonyms.)

The sexual harassment was so intolerable that these two employees felt compelled to quit their jobs, the EEOC says in the lawsuit.  Jane Doe was 18 years old when she started working for the company and 21 years old when she was forced to quit her job due to the sexual harassment.

The EEOC also charges that a restaurant manager, Dimitra Kokkinakos, had complained to management about the owner’s sexually offensive behavior but the company failed to take action to stop the harassment.  After learning that Kokkinakos had been in touch with Jane Doe, the restaurant warned Kokkinakos to “keep her mouth shut” and fired her in retaliation for her opposition to the sexual harassment.  The restaurant also threatened Kokkinakos when she participated in the EEOC investigation, including pressuring her to recant her testimony, according to the lawsuit.

Hospitality Industry Legal Risks: California Restaurant Sued By Woman “Sexually Assaulted” By Employee Near Restroom; Failed To Perform Background And Reference Check

A Foster City woman is suing a restaurant where a dishwasher attempted to rape her as she waited to use the restroom on New Years Eve 2011. Now Mary Hagan, 35, has filed a $1 million lawsuit against Straits in Burlingame, claiming it could have performed a background or reference check on Jose Mauricio Guicoy before hiring him.

Guicoy allegedly grabbed Hagan and began pulling her into a closet with his pants unzipped, reported the San Mateo County Times. She was able to fight him off.

Guicoy pleaded no contest to sexual battery, and was sentenced a month later to two years in prison.

Hospitality Industry Legal Risks: Woman Sues Illinois Hotel Over Bartender's "Sexual Assault"; Convicted Employee Allegedly Obtained Room Key From Front Desk

A Naperville man accused in a federal lawsuit of sexually assaulting a female guest of the Hilton Lisle/Naperville hotel has been convicted of a misdemeanor charge of trespassing in the woman’s room.

Jayson D. Dabrowski, a former bartender at the hotel, has been ordered to serve seven days in the Sheriff’s Work Alternative Program, or SWAP, according to records on file in DuPage County Circuit Court in Wheaton. Dabrowski has also been placed on two years of court supervision, records indicated.

The woman, a resident of Virginia, is seeking more than $75,000 in damages. Her lawsuit is not expected to come to trial for at least a year.

Hospitality Industry Legal Risks: Illinois Hotel Sued For $75,000 By Woman Claiming Bartender Drugged And Sexually Assaulted Her

A Virginia woman filed a lawsuit against a Lisle hotel claiming a bartender drugged her drink and later sneaked into her room with the help of a front desk clerk and sexually assaulted her.

The lawsuit, which was filed in federal court Wednesday, claims a 31-year-old bartender slipped a date-rape drug into the woman’s drink while she was at the Lisle-Naperville Hilton on Oct. 27. The woman began to feel ill at around 1:30 or 2 p.m. and went up to her room before her food had arrived at the hotel bar, said her attorney Jeffrey Deutschman.

Hospitality Industry Legal Risks: Woman Files "Negligence Lawsuit" Against Major Hotel Group After Front Desk Staff Gives Room Key To "Drunken Man" Who Assaults Her

A New York business woman is suing Starwood Hotels and Resorts Worldwide, claiming staff at one of their hotels gave her room key to a drunken man who allegedly sexually assaulted her in her bed.

Alison Fournier announced the suit today at a news conference with women’s rights lawyer Gloria Allred. According to the suit, Fournier was in her locked room in Hotel Kämp, a hotel operated by Starwood Hotels in Helsinki, Finland, on the night of Jan. 15, 2011 when she was sexually assaulted.

The man, who was “visibly intoxicated,” had undressed, slipped into her bed, and proceeded to grope her naked body, the suit says.

That same man, according to the suit, later went to the front desk, said that he was Fournier’s husband, and obtained a key from hotel staff to her room.

The staff did not ask him for any identification or proof that he was in fact Fournier’s husband, according to the lawsuit. He then proceeded to her room and tried to molest her. She awoke, grabbed a housecoat, and ran screaming from the room.

Hospitality Industry Employee Risks: South Carolina Hotel Maintenance Worker Arrested On Sexual Assault Charges For "Grabbing And Touching" Housekeeper "Inappropriately"

A Myrtle Beach man is behind bars after allegedly grabbing a co-worker inappropriately and causing her to be fearful of her safety a couple of weeks ago.

According to a police report, Myrtle Beach Police responded to a hotel in the 2700 block of N. Ocean Highway Saturday afternoon in reference to an assault that had taken place on Nov. 9.
 
She said she pushed Dooley off of her and told him to stop, and said they would both be fired if anyone saw his behavior. The victim also told police she told him not to touch her like that and told him to leave the room.
 
Dooley left but then allegedly returned 10 to 15 minutes later and reportedly exposed his genitals to the victim, touching himself.
The victim told police Dooley said things like “I am hanging to be a white boy” and “I love black Oreos” to her and she became afraid of him, scared he was going to attack her.
 
She then went to the head of housekeeping to tell her about what happened and the incident was reported to the hotel’s general manager. According to the victim, Dooley was then suspended from work.
Sunday, officers arrested Dooley and charged him with assault and battery in the second degree as well as indecent exposure.

Hospitality Industry Security Risks: Las Vegas Hotel Housekeeper "Sexually Assaulted" In Hotel Room; Security And Surveillance Measures Had Been Cut And Scaled Back In Recent Years

“…The number of security guards assigned to walk guest floors to monitor safety also has been scaled back over the years, said the employee, who suggested there should be at least one security guard at guest elevators to check identifications…”

A Las Vegas man accused of beating and raping a 65-year-old Strip hotel maid last week kept clothing in his home that may have been bloodied in the attack, police said.

According to his Las Vegas police arrest report, David Randell Ferren, 19, kept a bloody jacket, belt and condoms that may have been worn during the assault of a Bally’s hotel maid on the morning of Nov. 1.

The report alleges Ferren punched the maid in the face as she was entering a room on the 59th floor of Bally’s about 9:30 a.m. Security footage showed Ferren exiting an elevator on that floor shortly before the attack, police said.

In the arrest report, police said Ferren forced the maid into the room and raped her. The assault was interrupted after the occupant of the room entered. That woman told detectives she saw a naked man getting dressed as the maid fled the room, the report said.

Another maid saw the man using an emergency exit , the report said.
