Hospitality Industry Management Update: “3 Obamacare Decisions for Hoteliers”

Unless the act is repealed, over time employers will realize its effects, both positive and negative.illness(1920x1080) Rather than waiting around, however, employers are already adopting offensive moves to blunt financial impact beyond a certain level, seeking improved productivity through reduced costs and updated methods. 

Despite attempts by health care experts to demystify the Affordable Care Act, some employers remain unsure of how to comply. Their questions are basic and familiar: Who is a covered employer? What type of coverage must be offered? May we keep our 90-day waiting period for enrollment?

While these questions are important, a more urgent imperative looms: The deadline for many employers to comply with the mandated coverage provision of the Affordable Care Act is approaching rapidly. Some smaller companies will not face mandatory coverage decisions until 2016, but for many employers a compliant health coverage program must be in place as early as New Year’s Day 2015.

Critical decisions must therefore be made without delay.

Hospitality Industry Legal Update: “California Ranks Highest For Workers’ Compensation Costs”

California employers are required by law to have workers’ comp insurance, even if they have only one employee.Workers Comp (NO LOGO) The California Department of Industrial Relations (DIR) imposes assessments on employers to cover the cost of potential workers comp claims. The amount a business pays into the system depends on how many employees a business has and what its total payroll is.

California has been ranked as the most expensive state for workers’ compensation costs, according to a newly released report.

The Workers’ Compensation Premium Rate Ranking Summary from Oregon’s Department of Consumer and Business Services shows that California businesses spend $3.48 for every $100 of payroll issued.

That’s 188 percent of the median cost of $1.85 for all 50 states. California was the third most expensive state in 2012 and the fifth most expensive in 2010.

“California’s workers’ compensation system is incredibly inefficient,” said Jerry Azevedo, a spokesman for the California-based Workers’ Compensation Action Network, which seeks to reduce costs for employers and improve services to injured workers. “It does not do a good job of achieving its goal. For as much as employers pay, they don’t get a lot out of it.”

Hospitality Industry Legal Update: “Hotel Industry Threatens Legal Action Over New Wage Law”

Supporters dispute claims that the move was intended to help labor groups increase membership and say the higherLA mayor wages will lift working families out of poverty. Under the law, hotels with union workers can be exempted from the $15.37 hourly wage if workers agree…City Hall leaders on Wednesday rejected the criticisms. Councilman Mike Bonin, who advocated passage of the law, questioned the prediction that 533 hotel jobs will be lost in his Westside district.

Ratcheting up their opposition to a new law requiring larger hotels to pay workers $15.37 an hour, representatives for the hotel industry on Wednesday threatened to sue the city over the ordinance.

Standing outside Los Angeles City Hall, hotel operators and business leaders said they are considering a lawsuit based on federal laws. They also released new numbers predicting 1,488 jobs — including at least 140 in the San Fernando Valley — would be lost as Los Angeles hotels lay off workers to compensate for the wage hike.

Hospitality Industry Management Update: “Council to Vote on $15.37 Minimum Wage for Workers at Big Hotels”

“Several council members favor the increase, including Councilman Curren Price, who said it would make Los Angeles hotel workers wages“a progressive leader” for the nation…Some business groups warn that hotels could be forced to cut jobs if the plan passes. They cited a city-requested report released Monday that said hotel developers will bypass Los Angeles if the ordinance is approved.”

The drive to boost minimum wages in Los Angeles could reach a milestone this week as the City Council votes on a proposal to raise the hourly pay of thousands of workers at big hotels to at least $15.37.

That would be more than $2 an hour higher than the minimum wage Mayor Eric Garcetti is advocating for workers citywide.

Labor groups are rallying behind the plan now before lawmakers, saying that it could pull hotel workers’ families out of poverty and inject more spending into the local economy. Several council members favor the increase, including Councilman Curren Price, who said it would make Los Angeles “a progressive leader” for the nation.

Hospitality Industry Management Update: “Mayor Eric Garcetti Announces Minimum Wage Proposal for Los Angeles”

The proposal comes as the Los Angeles City Council is considering raising the wages of non-unionized hotel workers to $15.37 per hour.LA mayor Hotels near LAX that do not provide health care are already required to pay their employees a similar wage. Hotel operators that do offer health insurance must pay workers about $11 per hour. 

Following in the footsteps of cities like Seattle and San Francisco, Mayor Eric Garcetti made a Labor Day pitch for an increase, over the next three years, in the Los Angeles minimum wage to more than $13 per hour.

The mayor made the announcement in a South L.A. park at what’s billed as a “rally to address poverty in Los Angeles.”  His proposal would increase the city’s minimum wage to $13.25 an hour by 2017 and then tie the wage to the Consumer Price Index for urban wage earners.

Hospitality Industry Management Update: “Union Fight Divides Workforce at DoubleTree”

“…Organizers have been walking picket lines with workers and visiting employees at their homes,Double Tree and guests have been approached by union supporters in the lobby and have had fliers slipped under their doors. Over one weekend in early May, a push to get groups to cancel room reservations accounted for more than $30,000 in lost business, according to workers who reject calls for a union…”

An effort to organize employees at Hilton’s DoubleTree Suites has turned the hotel near the Charles River into a workplace that is sharply divided. On one side are housekeepers and other staff members fighting for more affordable health care and a collective voice. Resisting their efforts are administrative workers, restaurant servers, and others who don’t want to lose benefits offered by Hilton, which they say is a generous employer.

Both groups say they are in the majority.

STATEN ISLAND, N.Y. — Annadale resident Robert Esselborn and his family endured a staggering blow on Christmas Eve when his wife, Barbara, a popular school teacher, died nine days after suddenly taking ill. She was just 38.

The day before, Esselborn had been jolted on another front.

He was fired by reality-show-winning chef Anthony Paris from his night cook job at Manhattan’s chic Crosby Street Hotel for taking time off to care for his dying spouse, Esselborn alleges in a lawsuit.

Hospitality Industry Employee Update: “L.A. May Hike Minimum Wage for Hotel Workers to Highest in U.S.”

“Hotel owners and their representatives say a $15 minimum would trigger higher room rates and worker layoffs, as managements struggle to keep costs under control. The owners argue it’s unfair to take a piecemeal approach to pay rules — singling out a few industries or geographic areas.”

Labor leaders hope a proposal that would dramatically raise the minimum wage in Los Angeles for workers at large hotels to roughly $15 an hour will be a step toward pay hikes for other industries.

Members of the City Council expected to propose that large hotels pay their workers $15.37 an hour – more than double the national minimum of $7.25 an hour and push far above California’s rate of $8.

Union leaders want the increase to apply at hotels with 100 rooms or more, saying such a hike would lift housekeepers, busboys and maintenance workers out of poverty and inject much-needed cash into a  languorous local economy.
